TreatField, represented by individual entrepreneurs Poludonny Illia Viktorovych and Fedorets Anton Volodymyrovych, registered in accordance with the legislation of Ukraine, based on the provisions of Article 633 of the Civil Code of Ukraine, offer this Agreement to an unlimited number of persons for the purpose of proper, comfortable, lawful, high-quality use of the resource on the terms and conditions set out below.
1. Terms used in this document
1.1 TreatField Platform - an Internet site at https://www.treatfield.com, which contains information on psychology and related fields. The platform also provides an opportunity for Consultants to post information about themselves (their experience, specialisation, format of work) and provide individual consultations, based on the results of which the user of the website (Client) can obtain the necessary knowledge and information.
1.2 Consultant/Specialist/Therapist - a practicing psychologist, a specialist in the relevant field, who has duly executed documents confirming his/her education (psychological, pedagogical, social work or medical), work experience and qualifications, who provides information and knowledge in the field of practical psychology to an unlimited number of people, exchanges experience, knowledge, opinions with other Consultants, and provides his/her services on the TreatField platform in the manner prescribed by this Agreement and their agreement with Treatfield. The terms of Consultant's registration and access to the TreatField platform shall be regulated by a special agreement.
1.3 Consultation is one of the services offered on the TreatField platform. It involves the Client (authorised user) receiving a one-time online consultation or a multiple online consultation course in the field of practical psychology from one (or more) specialists presented on the platform. All consultations of all specialists represented on the platform are conducted online through the video service (Online Room) hosted on the TreatField platform (website https://www.treatfield.com).
1.3.1 Online Room/Video Service is a section of the website [https://www.treatfield.com](https://www.treatfield.com) (TreatField platform), through which communication (online audio and video communication) between the Client and the specialist (or specialists) is technically implemented, provided that both the client and the specialist have at their disposal a serviceable and properly connected necessary media equipment (webcam, microphone, headphones/speakers, etc.), as well as Internet access with a speed sufficient to support online video communication.
1.4 Public Offer - this agreement on the Terms of Service is a public agreement, which is considered to be concluded between Treatfield and the Client from the moment of acceptance by the latter of all terms and conditions of the Terms of Service of this Agreement without exception and which is the only source of regulation of all terms of service, privileges, relations between the Client and the Colsultant on the platform arising in the process of their implementation and compliance in the relevant field of knowledge. All advertising, presentation and other materials are created and exist for the purposes of Treatfield development and are for informational and reference purposes only. The acceptance of these Terms is mandatory for Clients interested in receiving information in the field of psychology and/or individual online consultations (video sessions) of specialists/practical psychologists through the service on the TreatField platform.
1.5 Acceptance - full and unconditional acceptance by the Client of the terms of the public offer, the Terms for the provision of the relevant services offered on the website/platform.
1.5.1 Acceptance is carried out by placing a tick in a special field in the modal registration/authorisation window of the website [https://www.treatfield.com] (https://www.treatfield.com/) during registration.
1.6. Client - the word "Client" means an unlimited number of persons who have completed the registration/authorisation process on the website https://www.treatfield.com (TreatField platform) and are interested in receiving advice in the field of practical psychology, or persons who are already receiving specialist advice through the service on the TreatField platform.
1.7 Content - all information on the website https://www.treatfield.com including (but not limited to) data, texts, software, music, sound, images, video, audio, graphics, presentations, publications, articles, user-generated content, messages and/or any other information.
1.7.1. User Content means all information published by users or clients of the TreatField platform. It includes, in particular, such types of user publications as a feedback to a Consultant or the TreatField platform.
2. Subject matter of the Terms and Conditions
2.1. TreatField is an online platform through which the Client can get acquainted with information, data in the field of practical psychology, find a consultant in the field of practical psychology and receive an individual online consultation (video session).
2.1.1. The procedure for obtaining an online consultation service:
a) The user goes to the website https://www.treatfield.com;
b) In order to access the personal account and receive online consultations, the user must register (or authorise if the user is already registered). After registration/authorisation, the user is called a Client.
c) The Client selects a professional in the relevant section of the platform.
The Client contacts the Consultant through the TreatField platform service and arranges a consultation time.
d) After setting the date and time of the consultation, the Client can make a mandatory prepayment through the TreatField service. The funds are reserved on the Client's account, but will be debited only after the consultation.
e) The Client receives a consultation.
f) The Consultant sends a request, after which the funds are debited from the Client's account and the service is considered paid and delivered.
2.1.2. The terms of the Consultant's registration and the possibility of access to the TreatField platform are regulated by a special agreement.
2.2. TreatField provides an online platform for specialists in the field of psychology - providers of consulting services (hereinafter referred to as Psychologists/Consultants/Therapists) and an unlimited number of persons (after authorisation - Clients) interested in obtaining information in the field of psychology and/or in individual online counselling (video sessions).
2.3. The website https://www.treatfield.com (TreatField platform) DOES NOT provide medical services and/or consultations in the field of medicine and related fields.
2.4 The information on https://www.treatfield.com (including, but not limited to, data, text, software, music, sound, images, video, charts, graphics, presentations, messages and/or any other information ("content"), does not constitute (in substance or form) medical advice of any kind and is not intended to diagnose or identify treatment for a medical condition. Nothing on the Website https://www.treatfield.com may be construed as an attempt to offer or render medical advice or otherwise engage in medical practice.
2.5. By accepting this agreement, you also agree that you may not use any function provided by the platform to obtain or order prescriptions for medicines/any medical prescriptions for diagnosis or treatment. Obtaining prescriptions/any medical prescriptions for diagnosis, treatment through or with the help of the services provided by the platform is strictly prohibited and is a ground for termination of your account.
2.6 The TreatField platform declares that it is not responsible for any such prescriptions/any medical diagnosis or treatment.
2.7. Do not use the website https://www.treatfield.com (TreatField platform) to receive medical care (including emergency care).
2.8. The Platform does not recommend, endorse, support, evaluate, or guarantee any advice, treatment information or links to medical facilities, products, procedures, doctors, consultants, coaches (trainers), psychotherapists, tests, any other opinions, or any other information provided by any Consultant on the website https://www.treatfield.com.
2.9. The use of the Platform by an unlimited number of persons (and after authorisation - by the Client) cannot be interpreted as an endorsement, recommendation or guarantee by the platform of the services/information provided by any Consultant.
2.10. The TreatField Platform does not and cannot guarantee the legality, accuracy, completeness, security, quality of content or anything said or written by any Consultant, including any information contained in the Consultant's profile.
2.11. The TreatField platform is not responsible for any losses arising from the recommendations and links to information provided by any Consultant authorised on the TreatField platform.
2.12. The services provided by Consultants on the TreatField platform are provided on the basis of your voluntary personal request in oral and written forms, including using information and telecommunication technologies.
2.6 The TreatField platform declares that it is not responsible for any prescriptions/any medical diagnosis or treatment.
2.7. Do not use the website https://www.treatfield.com (TreatField platform) to receive medical care (including emergency care).
2.8. The Platform does not recommend, refer to, endorse, support, evaluate, or guarantee any advice, treatment information, links to medical facilities, products, procedures, doctors, consultants, coaches (trainers), psychotherapists, tests, any other opinions, or any other information provided by any Consultant on the website https://www.treatfield.com.
2.9. The use of the platform by an unlimited number of persons (and after authorisation - by the Client) cannot be interpreted as an endorsement, recommendation or guarantee by the platform of the services/information provided by any Consultant.
2.10. The TreatField Platform does not and cannot guarantee the legality, accuracy, completeness, security, legality, quality of content or anything said or written by any Consultant, including any information contained in the Consultant's profile.
2.11. The TreatField platform is not responsible for any losses arising from the recommendations and links to information provided by any Consultant authorised on the TreatField platform.
2.12. The services provided by Consultants on the TreatField platform are provided on the basis of your voluntary personal request in oral and written forms, including using information and telecommunication technologies.
3. Updating the Terms of the TreatField online platform
3.1. In order to ensure the correct, proper, safe and continuous functioning of the TreatField platform, taking into account the principles of ethics, confidentiality, professionalism mandatory for such services as the TreatField platform, these Terms have been developed.
3.2. The acceptance of these Terms is mandatory for Clients interested in obtaining information in the field of practical psychology and/or individual online consultations (video sessions) from Consultants through the service on the TreatField platform.
3.3. These Terms are an agreement on access to the platform, which, among other things, obliges the user to comply with them.
3.4. The Platform reserves the right to change and update the Terms for the most correct, proper, safe and continuous functioning, which means the availability of the possibility (including technical), as well as the right to change or modify these Terms at its own reasonable discretion without prior notice.
3.5. The user (Client) agrees to visit this section of the page to read and accept the current terms of use - the current version of the Terms.
3.6. Without exception, all changes/additions to the Terms are posted in this section of the page and contain the appropriate link for easy identification, familiarisation, acceptance or cancellation of the agreement. The Platform reserves the right to determine the acceptability of the Terms, the frequency of their monitoring and is ready to answer all questions/comments/suggestions.
3.7. Your further use of the resources presented on the platform after any such changes means your acceptance of the new terms of use.
4. Age restrictions
4.1 Given the variability of different jurisdictions on the issue of the permissibility of minors' access to various types of content and the mission of the TreatField platform to make practical psychology consultations available worldwide, persons under 18 years of age may use the services of the practical psychology specialists presented on the website https://www.treatfield.com only with the consent of their parents or guardians. The TreatField platform does not have any prohibited content or services that are age-restricted. The TreatField platform uses this restriction to avoid misunderstanding, without intending to violate the laws of different jurisdictions and in particular to prevent and not cause any harm or damage to anyone.
4.2. By agreeing to this Terms and making an acceptance (see paragraph "Acceptance"), you also confirm that if you are under the age of 18, you have received the consent of your parents or guardians to receive consultations through the TreatField platform service. The TreatField Platform shall not be liable if you knowingly violate this restriction or ignore it for any reason.
5. Registering on the TreatField online platform
5.1. You do not need to register to visit the website and access certain functions and sections of the TreatField platform. However, in order to get in touch with Consultants, you must register and create an account. Your account gives you access to services and functionality of the Platform.
5.2. Thus, registration (authorisation) on the TreatField platform is a condition for accessing and using certain functions, including, but not limited to, access to content and profile creation, access to the online room.
5.3. Registration data and some other information about you are protected and governed by our [privacy policy] (https://www.treatfield.com/page/privacy-policy).
5.4. By agreeing to these Terms, you also agree to the provisions and Terms of the Law of Ukraine "On Personal Data Protection" and express your consent to their processing and storage.
5.5. In accordance with these Terms, you are responsible for maintaining the confidentiality of your password and account and are fully responsible for all actions that occur under your password or account. You also agree to:
a) immediately notify TreatField of any unauthorised use of your password or account or any other breach of security;
b) ensure that you log out of your account completely at the end of each session or after using the TreatField platform service.
5.6. The TreatField Platform shall not be liable for any losses or damages arising from your failure to comply with the requirements of this section.
5.7. You can receive consultations using the video service (online room). The TreatField platform acts solely as a passive provider of such online consultations.
5.8. The TreatField Platform does not give any guarantees regarding the content of any reply and/or message from the Consultant and/or the information contained therein.
6. Payments
6.1. Your Consultant may charge for services, cancelled consultations and scheduled visits. You are solely and personally responsible for this fee and agree that the TreatField platform (using the payment service it cooperates with) may charge your payment card for such services. The rules of payment are regulated by the TreatField platform.
6.2. Each Consultant places his/her price list on his/her profile page.
6.3. The TreatField platform and Consultants can add new services for an additional fee or change the fee for existing services at any time at their discretion.
6.4. By accepting these Terms, you acknowledge and agree to be fully responsible for all costs incurred by you in order to connect to the service, including, but not limited to, obtaining and maintaining all computer and other equipment necessary to use the service provided by the TreatField platform.
7. Rescheduling and missing the consultation. The "24-hour rule"
7.1. The Client has the right to request cancellation or rescheduling of any scheduled Consultation without any costs or penalties if such a request meets the following points simultaneously
а) The request to cancel or postpone the scheduled Consultation is made at least 24 hours before the scheduled Consultation (counting according to the client's time zone);
b) The request is made by sending a message to the Consultant via the website service https://www.treatfield.com. Any form of communication, except for communication through the TreatField service, cannot be counted;
7.2. The request is considered invalid and/or the Consultant has the right to consider the consultation paid and charge the reserved (holded) funds from the client's account in the following cases
а) The Client has requested to cancel or postpone the scheduled specialist consultation less than 24 hours (counted according to the Client's time zone) before the scheduled consultation;
b) At the moment less than 24 hours before the scheduled session (counted by the Client's time zone), there is no formalised request from the Client in the message to the Consultant via the website service https://www.treatfield.com. Any form of communication, except for communication through the TreatField service, cannot be counted;
c) The Client has missed a consultation without any warning or a duly executed request.
7.4. The request for cancellation or postponement of the appointed consultation by the Consultant shall be considered invalid and/or the Client shall be entitled to receive the next consultation free of charge in the following cases
а) The Consultant has requested to cancel or reschedule the scheduled consultation with the Client less than 24 hours (counting according to the Client's time zone) before the scheduled consultation;
b) At the time of less than 24 hours before the scheduled session (counted by the Client's time zone), there is no formalised request from the Consultant in a message to the Client via the website service https://www.treatfield.com. Any form of communication, except for communication via the TreatField service, cannot be counted;
c) The Consultant has missed the scheduled consultation without any warning to the Client or a duly executed request.
8. User Content
8.1. The services provided through the TreatField platform may allow Clients to post feedback, comments, questions and other information (hereinafter referred to as "User Content").
8.2. By accepting these Terms, you agree that you are solely responsible for your User Content that you upload, publish, display, link to or otherwise make available on the Platform.
8.3. By accepting these Terms, you understand and agree that the TreatField platform acts only as a passive conduit for the distribution on the Internet and publication of your User Content.
8.4. By accepting these Terms, you understand and agree that if such user content is published, the TreatField platform does not guarantee confidentiality in respect of any such content, but at the same time does its best to adhere to the declared principles of security and respect for the privacy of its client.
8.5. By accepting these Terms, you understand and agree not to post User Content that:
a) may create a risk of harm, including moral, loss, physical or mental injury, emotional distress, death, disability, injury and/or physical and/or mental illness, to you, any other person, or any animal
b) may create any other risk of loss or damage to any person or property;
c) seeks to harm or exploit children;
d) may constitute or facilitate a crime or civil offence;
e) contains any information or content that TreatField considers unlawful, harmful, offensive, may qualify as a racial or ethnic slur, copyright infringement, violating privacy or the right to publicity, abusive, humiliating to others, defamatory, threatening, obscene, indecent;
f) contains any information or content that is illegal. You agree that any User Content you post does not and will not violate any third party rights, including without limitation any intellectual property rights, rights of publicity and privacy.
8.6. You retain all of your ownership rights to your User Content. By posting any User Content on the Platform, you hereby transfer the rights thereto to the TreatField platform free of charge, and you warrant that you grant the TreatField platform a worldwide, royalty-free, transferable, perpetual, irrevocable, non-exclusive right to use, reproduce, modify, publish, edit, translate, distribute publicly, and create derivative works from such User Content in general or in particular, and in any form, media or technology now known or hereafter developed, for use in connection with the TreatField platform business.
8.7. You also grant each service user a non-exclusive right to access the user's content through the TreatField platform, and a non-exclusive right to use, reproduce, distribute, display and perform such user content as permitted through the functionality of the service and in accordance with these Terms.
8.8. The TreatField platform service has implemented and uses reasonable technical and organisational measures aimed at ensuring the security of your personal information from accidental loss and from unauthorised access, use, alteration or disclosure. However, we cannot guarantee that third parties will never be able to hack/breach/overcome/bypass these measures or use your personal information for unlawful purposes. You acknowledge that you provide your personal information at your own risk, with all the consequences that may entail.
9. Consultants
9.1. In connection with the use of the website and services in order to schedule meetings with Consultants, you understand that
9.1.1. The TreatField platform authorises the Consultants who will be displayed on the Website on the basis of previously concluded agreements with them.
9.1.2. Consultants are not employees of the TreatField platform. The TreatField platform does not enter into an employment relationship with any of the presented Consultants.
9.2. Users are solely responsible for choosing their own Consultant or consulting service provider.
10. Liability of the parties
10.1. The TreatField Platform uses a number of additional online (and other) services developed and maintained by the respective companies and developers. The TreatField Platform is not responsible for and does not guarantee the uninterrupted operation of these services. The TreatField Platform reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice.
10.2. You agree that the TreatField Platform shall not be liable to you or any third party for any modification, suspension or discontinuance of the Services. However, the TreatField platform does its best to anticipate situations of failure of certain services of the platform, to warn users and Clients in advance about the termination of certain services of the platform, to adjust the operation of these services as soon as possible and to make the use of these services convenient.
10.3. In case of detection of a malfunction of any service of the TreatField platform or termination of its operation, the User/Client should use the feedback form (the "Ask a question" button in the top menu of the site) to inform the TreatField platform about it. The TreatField platform will do its best to restore the operation of the relevant service as soon as possible.
10.4. You are solely responsible for the User Content that you upload, send, post, display or send via email, or in a letter, or otherwise used through the service. TreatField reserves the right to investigate the use of the website or any TreatField services by clients/users/Consultants and/or other third parties at its sole discretion, subject to our Privacy Policy and any professional confidentiality obligations between you and your Consultant.
10.5. The TreatField Platform may take appropriate legal action against those who use the TreatField Platform website or services inappropriately, including (but not limited to) suspending or terminating the account of such violators and reporting to law enforcement authorities.
10.6. You agree not to use the TreatField platform service to send by email or otherwise transmit outside of any counselling sessions any information that:
a) is illegal, abusive, harmful, excessively cruel, offensive, obscene, defamatory, violating privacy, or infringing the rights of third parties;
b) if you are not entitled to transmit the relevant information by law or under a contractual or other relationship;
c) that presents or creates a risk of a breach of confidentiality or a risk of danger to any person;
d) that may expose TreatField and/or its users to any loss or liability of any kind; impersonate any person or entity, falsely or otherwise misrepresent your identity; advertise or offer to sell or buy any goods or services for any commercial purpose without being authorised; violate any relevant local, state, national or international laws or any regulations having the force of law; use the Services in any manner that could damage, disable, overload, or impair the Service or interfere with any other party's use of the Service; obtain or attempt to obtain access to any materials or information through any means not intentionally made available or provided for through the TreatField platform service.
10.7. The platform does not take any part in communications (online sessions) between the Consultant and the Client, does not have (and cannot have) any influence on that process, does not control and is not responsible for the content of messages or any other forms of communication made during or in the context of consulting by the Consultant on the website (including through the video service).
10.8. The content of the messages and responsibility for them is fully borne by the person from whom such message originates. The content of messages may be protected by intellectual property rights owned by third parties. The TreatField platform reserves the right (but does not assume any obligations) to check whether any content of the messages you use complies with these Terms. Each Client and Consultant agrees that such Consultant or such Client, as the case may be, may (subject to professional duties of confidentiality between clients and their consultants) report or recommend to the TreatField platform for investigation of violations, subject to our privacy policy.
10.9. The TreatField platform reserves the right (but does not assume any obligation) to take appropriate legal action against anyone who violates this clause while using the website or during the consultation (including in the video service), to restrict, terminate or suspend the registration of such violators and to report them (violators) to law enforcement agencies. Each Client and Consultant also agrees that upon such notification or recommendation, the TreatField Platform may, at its sole discretion, remove such content and/or terminate or suspend the user's account after using any content that is in violation of this user agreement.
10.10. All your interactions with consultants take place through the service and within the service of the TreatField platform. You understand and agree that the TreatField platform is not responsible and will not be liable for any interaction that occurs between you and the Consultants outside the service(s) provided by the TreatField platform, and you agree to indemnify and hold TreatField platform harmless from any claims arising from such interactions.
10.11. In case of malfunction of any service of the TreatField platform or termination of its operation and, as a result, the impossibility of proper receipt of the service (consultation), the TreatField platform does not recommend that Clients interact with Consultants outside the service of the TreatField platform.
10.12. In case of detection of a malfunction of any service of the TreatField platform or termination of its operation, the User / Client should use the feedback form (the "Ask a question" button in the top menu of the site) to inform the TreatField platform about it. The TreatField platform will do its best to restore the functionality of the relevant service as soon as possible.
10.13. You understand and agree that the TreatField Platform has absolutely no control over the Consultants and shall not be liable if your Consultant is unavailable and cannot guarantee the availability of any Consultant at any particular time, but may recommend other Consultants.
10.14. The TreatField platform is not responsible for payment transactions and uses the services of an external payment processing service. If the Client believes that there has been an error, he or she may notify the TreatField platform.
10.15. The payment service used by the TreatField Platform is not flawless; therefore, the TreatField Platform is not responsible for any problems, miscalculations or failures in the transfer of payment processing to the external payment system from the user.
10.16. The Service and/or third parties may provide links to other sites and resources on the Internet. The TreatField platform has absolutely no control over such sites and resources and is not responsible for them and does not endorse such sites and resources. You acknowledge and agree that TreatField Platform shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, events, goods or services found on or available for use on such sites or resources, or through any hyperlinked site or resource.
10.17. You agree to indemnify TreatField and its authorised representatives from all losses, expenses, including attorneys' fees, rights, claims, actions of any kind and damages arising out of your use of the service, any content published on or through the service. This section includes, without limitation, any claims resulting from the criminal acts of others.
10.18. By this agreement, you acknowledge that you use the Treatfield platform service at your own risk. The Services and any content or material downloaded or obtained through the Service are provided on an "as is" and "as available" basis. Treatfield disclaims all warranties of any kind, express or implied.
10.19. The Treatfield Platform makes no warranty that: a) the services will be effective or produce any result, b) the service will be uninterrupted, non delayed or error-free, reliable or accurate or meet your requirements, c) the service will be uninterrupted, timely, secure, error-free or available at any time or location, d) the results or information that may be obtained through the use of the service will be accurate, reliable, timely or complete, e) the quality of any goods, services, information or other materials purchased or obtained by you through the service will meet your requirements, f) errors will be corrected.
10.20. You understand and agree that TreatField shall not be liable for any direct, indirect, special, incidental, consequential, punitive or exemplary damages, including but not limited to loss of goodwill, use of data, or other intangible damages (even if TreatField has been advised of the possibility of such damages), whether based in contract, tort, negligence, strict liability or otherwise, resulting from a) the use or inability to use the services; b) purchased goods or services, data, information or communications received either through or from the service; c) unauthorised access to or alteration of your communications or data; d) statements or behaviour of third parties on the site; or e) any other problems related to the service.
10.21. In no event and under no circumstances shall TreatField be liable to you for any loss, damage or claim. If you are dissatisfied with any part of this service or the service related to the service or these terms of service, your exclusive remedy is to discontinue using this service.
10.22. Any disputes may be settled in court.
10.23. TreatField may also, in its sole discretion and at any time, discontinue the Services or any part thereof, with or without notice. You agree that any termination of your access to the Service pursuant to any provision of these Terms of Use may be effected without prior notice, and you acknowledge and agree that TreatField may immediately deactivate or delete your account and all related information and files in your account and/or prohibit any further access to such files or the Services.
10.24. You further agree that TreatField shall not be liable to you or any third party for any termination of your access to the Service.
10.25. Any case that raises suspicions of fraudulent, abusive or illegal activities that may be grounds for termination of the use of the service may be referred to the relevant law enforcement authorities.
10.26. You agree that you are solely responsible for your interactions with any other user of the Service, including Consultants. The TreatField platform reserves the right, but is not obliged, to become involved in any proceedings or disputes between you and any other user of the service.
10.27. These Terms of Use constitute the entire agreement between you and the TreatField platform and govern your use of the Service. These Terms of Use are governed by the laws of Ukraine. The failure of TreatField to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
11. Personal use
11.1. Unless otherwise specified, you agree not to display, distribute, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, use or transfer for any commercial purpose any part of the TreatField Platform service, use of the TreatField Platform service or access to the TreatField Platform service.
12. Intellectual property rights
12.1. By accepting these Terms, you acknowledge and agree that the services and Content available through the TreatField Platform website are protected by copyright, patent, trademark or other intellectual property rights, except as specifically authorised by the TreatField Platform.
12.2 You agree not to modify, copy, sell, distribute or create derivative works based on the Service or the TreatField Platform Content, in whole or in part, except that the foregoing does not apply to your own published content that you lawfully upload to the site. Provided that you are authorised to use the Services, you agree not to copy, modify, create derivative works from or otherwise attempt to derive the source code of, sell, license or otherwise transfer the rights to the content of the TreatField Platform site. Any rights granted herein are reserved by the TreatField Platform.
12.3 In no event shall TreatField be liable for any information posted or transmitted by third parties, including Consultants or Clients, including, but not limited to, any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted on the site or transmitted by email or otherwise communicated through the service. You acknowledge that TreatField does not screen content, but TreatField and its designees have the right (but not the obligation) in their sole discretion to refuse to post or remove any content that may be posted through the service. Without limiting the foregoing, TreatField and its designees have the right to remove any content that violates these terms of use or for any other reason in the sole discretion of TreatField and its designees. You agree that you must independently evaluate and bear all risks associated with the use of any content.
12.4. By accepting these Terms, you are solely responsible for the content and other materials that you post on the site or through the service. You will not post any content that you did not create or if you do not own all rights, including all copyrights to it. By posting any information, any content published on the site, you grant and will grant the TreatField platform the right to copy, display, transmit, distribute, store, modify and use it in perpetuity, irrevocable permission.
12.5. The TreatField Platform may use the published content at its discretion for any purpose, including for promotion, advertising or marketing, in any form, using technologies now known or later developed.
12.6 You acknowledge and agree that TreatField may preserve content and may also disclose its contents if required to do so by law or if disclosure is necessary to: a) comply with legal process to the satisfaction of applicable law, or b) meet governmental requests; c) enforce these Terms of Use; or d) respond to claims that any content infringes the rights of third parties.
12.7. The TreatField platform respects the intellectual property of others and expects our Clients and Consultants to do the same. If you believe that your work has been copied in violation of copyright or that your intellectual property rights have been violated, you may notify the TreatField platform.
13. Other terms
13.1. If any provision of these Terms of Use is found to be invalid by a court of competent jurisdiction, the parties agree that the court shall endeavour to give effect to the intentions of the parties as reflected in the provision and the other provisions of these Terms of Use shall remain in full force and effect. You agree that, notwithstanding any statute or law to the contrary, any claim or cause of action arising out of or relating to the use of the Service or these Terms of Use may be filed within the statute of limitations after such claim or cause of action is forever barred.
13.2. A printed version of this agreement and any notice in electronic form is admissible in a judicial or administrative proceeding based on or in connection with this agreement to the same extent and under the same conditions as other business documents and records originally created and maintained in printed form.
13.3. The section headings of these Terms of Use are for convenience only and have no legal or contractual effect. Notifications to you may be made by e-mail or by regular mail. The Service may also provide you with notices of changes to these Terms of Use or other matters by displaying notices or links to notices on the site.
13.4. You may not transfer or sublicense these terms of use to third parties for anyone else to use the service, and any attempt to do so is void.

13.6. By using the TreatField platform service, each user understands and agrees that all advice, information, practices, sessions, products, specialists, consultants, tests, opinions or other information or services in writing or provided by consultants in any form, – are neither provided by employees, of the TreatField platform nor controlled by the TreatField platform. Each user understands and agrees that the TreatField platform cannot fully predict or evaluate the competence of any Consultant presented on the site and its suitability for the Client's needs.
13.7. The TreatField platform is not responsible for cancelled consultations or any unfulfilled agreements between users and Consultants or any harm arising from this, or damage resulting from the use of the TreatField platform in general.
13.8. Users are strongly advised to conduct their own research to select a Consultant.
13.9. Users who interact with Consultants on the site acknowledge that such relationship is solely with the professionals with whom they interact and in no way with the TreatField platform.
13.10. The TreatField platform does not take any part in such relationships of consultancy or information provided on the website by Consultants, and does not verify the information or recommendations provided to any user by their Consultant. Each user hereby undertakes not to cause any damage to the TreatField platform.
13.11. Consultants hereby acknowledge that they are solely responsible for any advice, information, methods, references to other professionals, consultants, procedures, tests, opinions or any other information or services provided in any form to any user of the TreatField platform.
13.12. By registering on the TreatField platform (including registration through social networks), each user automatically agrees to receive messages from the platform, as well as platform news, information about promotions, new content or functionality and other information via the email specified during registration. Email newsletters are one of the forms of communication between the platform and the platform user. If the user does not want to receive any information from the platform, except for messages accompanying the use of the platform functionality (session appointment, session cancellation, session payment, etc.), the user can unsubscribe from the newsletter using the hyperlink at the end of each email.
